Structuration d’un champ d’action publique : l’intervention publique sur les copropriétés dégradées - 01/03/10

Cet article s’intéresse à la construction sociale du problème des copropriétés dégradées, apparu en France dans les années 1980, et à celle des instruments d’action publique qui l’a accompagnée. Il s’appuie sur la sociologie de l’action organisée pour analyser ce double processus, qui résulte de la formation de réseaux d’acteurs étrangers au droit de la copropriété. Ces réseaux, reliant la périphérie au centre, se sont cristallisés autour de normes issues de la politique du logement. La notion de champ, au sens wébérien du terme, rend compte de cette cristallisation. Elle s’applique aussi au processus, symétrique, qui a conduit à la conservation du droit de la copropriété : des acteurs, attachés à ce système normatif, ont récusé le problème des copropriétés dégradées lorsqu’il s’est présenté à eux. Dans les deux cas, des individus développent une activité sociale qui repose sur l’application et la production de règles. Ils contribuent ainsi à leur conservation mais aussi à leur renouvellement.

This article focuses on the social construction of the problem, which emerged in France during the 1980s, of dilapidated condominium apartment buildings and on the public policy instruments that have been used. A sociology of organized action serves to analyze this twofold process, which has resulted from the formation of networks of persons unfamiliar with the legal aspects of condominium ownership. Linking the periphery to the center, these networks have crystallized around norms ensuing from housing policy. The concept of “field” in the Weberian sense explains this crystallization, and also applies to the symmetrical process of conserving civil law on joint ownership. Parties attached to this normative system denied the problem of dilapidated condominiums, when it was presented to them. By pursuing a social activity based on applying and producing rules, individuals in the networks related to housing policy and persons concerned by condominium ownership contributed to maintaining and, too, revitalizing rules and norms.
