Le Code de la santé publique place l’information du patient en cas de dommages associés aux soins sous l’angle de la subjectivité du patient
Cependant la notion de dommage sous-entend une objectivation pour laquelle, dans les champs assurantiel et judiciaire, un tiers intervient
Dans celui des soins, le professionnel devant informer le patient est à la fois juge et partie
Comment peut-il respecter la subjectivité du patient et sortir de cette position ?

The French public health code considers the informing of the patient in the event of injuries associated with medical care from the perspective of the subjectivity of the patient. However, the notion of injury implies an objective perspective for which, in the insurance and legal fields, a third party intervenes. In the field of care, the health professional who has to inform the patient of an injury is both the judge and a party in the case. How can he or she respect the subjectivity of the patient and do better with this position?
