L'information au donneur vivant - 26/02/08

Ne pas informer sur la possibilité thérapeutique de la greffe avec donneur vivant constitue en aucun cas un geste nul. Ne pas informer équivaut à délibérer à la place du donneur potentiel et du receveur, c'est-à-dire à s'approprier, sans droit et contre le droit, l'usage de leur libre arbitre. Simultanément, ne pas informer, c'est communiquer. C'est affirmer, de manière implicite, deux points de vue : d'une part, le patient est incapable de pouvoir disposer d'un tel choix et d'autre part, les convictions éthiques et morales du médecin prévalent sur celles du patient. Assurément délivrer l'information sur cette possibilité thérapeutique ne peut être en aucun cas un acte neutre. La teneur persuasive ou dissuasive de la communication influencera le patient. Pourtant délivrer l'information demeure la condition minimale à l'exercice du libre arbitre ; en ce sens, cet acte ne peut faire l'objet d'un choix. Il faut donc réfléchir et travailler ensemble à une manière de délivrer l'information qui permet l'exercice optimal du libre arbitre. Pour ce faire, il faut commencer par désenclaver l'enjeu de l'information d'une position militante où informer signifie « être pour » cette thérapeutique et ne pas informer signifie « être contre ».

Withholding information about the possibility of making a living organ donation is not a neutral act: not to inform means to decide on behalf of the potential donor and the recipient, and to deny them, without any right and against their rights, their free will. It is also to declare implicitly two opinions: first, the donor and the recipient are unable to make the right decision; second, the ethic and moral convictions of the physician count for more than those of the donor and recipient. On the other hand, providing this information is not a neutral act either: to the extent that the presentation comes across as persuasive or dissuasive, the decision of the recipient and the donor will presumably be affected accordingly. Nevertheless, having access to information is a minimal condition for the donor and recipient to exercise their free will. For this reason, we should try to imagine a system in which patients receive all pertinent information about the possibility of a living organ donation, in a manner that is not coloured by partisan positions.
