La prise en charge d’un mineur en chirurgie pédiatrique doit être respectueuse des droits du jeune patient, en particulier en matière de consentement aux soins et de sécurité des informations.  Les titulaires de l’autorité parentale restent toutefois les garants légaux des droits et intérêts du mineur, jusqu’à sa majorité (sauf exceptions légalement circonscrites). Durant son hospitalisation, il revient aux équipes de soins de préserver, à leur tour, les droits du patient mineur, mais aussi ceux de ses représentants légaux, en visant l’intérêt de l’enfant.

The care of a minor in pediatric surgery must respect the rights of the young patient, particularly in terms of consent to care and security of information. However, holders of parental authority remain the legal guarantors of the minor’s rights and interests until he or she reaches the age of majority (except in the case of legally circumscribed exceptions). During hospitalization, it is the responsibility of the care teams to safeguard the rights of the minor patient, as well as those of his or her legal representatives, with the best interests of the minor in mind.
