La vérité au malade, jusqu’où ? Quels risques ? - 25/11/09

La loi du 4 mars 2002 affirme explicitement le droit des malades à l’information les concernant. Pourtant la relation clinique qui unit un médecin à son malade est complexe. Dire la vérité est parfois considérée comme plus préjudiciable que bénéfique pour le malade. Mais le risque est alors que le silence devient la règle. Définir ce concept de vérité ainsi que son implication dans la relation médecin–malade est primordial pour comprendre jusqu’où la vérité peut être dite. Le diagnostic et le pronostic offrent des pistes de réflexion sur la singularité de cette demande de vérité. Le médecin et sa conscience, d’une part, le malade et sa confiance, d’autre part, présument du respect du libre-arbitre de chacun. Comment ne pas déléguer la rencontre ? Quelle relation établir, pour quelle alliance thérapeutique à construire ?

In France, patient access to information is regulated by the law of March 4, 2002. In the complex situation of a clinical relationship, telling the truth can sometimes be considered more deleterious than beneficial. But if clinicians refrain from telling the truth, there is a risk that the unsaid becomes the rule. Here we develop a more complete definition of the concept of truth and its implications in the patient–physician relationship. The notions of diagnosis and prognosis offer the opportunity for deeper thought on the singularity of this (re)quest for truth. Considering the patient–physician relationship in terms of a relationship between two individuals with their own consciences opens the way to a better understanding of free will. In this context, how can clinicians avoid the pitfall of delegating information delivery? What type of relationship should be established, for building what kind of therapeutic alliance?
