As for any physician, the responsibility of an occupational physician can be involved. He is in a position to be personally prosecuted and sanctioned for a criminal offence (criminal responsibility). He is obliged to repair, through his work insurance, an injury caused to others (civil liablility). In the case of an occupational physician who works for the public sector, it is the administrative responsibility that is involved. But, the occupational physician's responsibility can also be engaged, with the work code and the social security code. It is a specific responsability because of the administrative missions of occupational medicine. The dispute about aptitude is special, seeing that the recourse is taken before the factory inspector, who will give a judgment after consultation of the factory inspector physician. Theoretically, the judicial magistrate can not command an expert's report in order to control the validity of the medical advice. The occupational physician does not incur direct sanctions in case of contestation of the capacity advice. Finally, every physician is bound to respect the rules of the medicine professional code of ethics.
